Divorce requirements in Tampa
In order to obtain a divorce in Florida, also known as dissolution of marriage, you or your spouse must reside in the State of Florida for at least 6 months prior to filing a petition for divorce. If you meet the residency requirement, our attorneys can help you begin the divorce process by filing a petition for dissolution of marriage in the Tampa family court and serving a copy of the petition and a summons to court to your spouse. You must also complete an unsigned, anonymous informational questionnaire and file it with the clerk of the circuit court for use by the Florida State University Center for Marriage and Family for research purposes.
Grounds for divorce
Florida is what is called a no-fault divorce state. This means that you do not have to prove any reason for your divorce other than that the marriage is irretrievably broken or that your spouse is mentally incapacitated and has been for at least three years. However, issues such as adultery, abuse or substance abuse may affect elements of divorce such as child custody or the division of marital assets.
